About these terms

These terms are an agreement between you and Skyscrap (“we”, “us”) about the Skyscrap game, the website at skyscrap.fun, our game servers and related services (the “services”). By using the services you agree to these terms. If you don’t agree, please don’t use them.

These documents are part of the agreement too: the community guidelines, the copyright and fan content policy and, for how we handle personal data, the privacy policy.

Who can play

• You must be at least 13, or older if the law where you live sets a higher minimum age.
• If you are under 18, or under the age of majority where you live, you need a parent’s or guardian’s permission, and they accept these terms on your behalf.
• Online play may have a higher minimum age. At launch it may be open only to players 18 and over; the game asks your age before your first online match.
• You can’t use the services if the law forbids it, or if we have previously banned you.

Skyscrap is in development

Skyscrap is being built in the open. Features will be added, changed and removed. During development, including any beta, we may reset profiles, statistics or settings, and the services may sometimes be slow or unavailable. We’ll try to give notice of big changes, but we can’t promise that any feature will stay the same or stay available.

Your licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to access and play Skyscrap for your own entertainment, subject to these terms. Streaming and videos are welcome under our fan content policy.

You must not:

• copy, sell, rent or redistribute the game or its parts, except as these terms allow;
• reverse engineer, decompile or modify the game or its network traffic, except where the law allows it regardless of these terms, and never to build cheats;
• access the services with bots, scripts or automated tools, other than an ordinary web browser;
• attack, overload or interfere with our servers, networks or other players’ connections; or
• get around security measures, bans or other limits we put in place.

Guest profiles and online play

When online play launches you’ll get a guest profile without signing up: a guest ID, a callsign with a tag, and a recovery code. Keep the recovery code private. Without it we may not be able to restore a lost profile.

• One person per profile. Don’t share, sell or transfer profiles.
• Profiles with no play for 180 days may be deleted.
• Statistics and profiles may be reset during development or to deal with cheating.

Playing fair

Follow the community guidelines. In short, you must not:

• cheat, use hacks, modified clients, macros or automation, or exploit bugs (report them instead);
• harass, threaten, bully or discriminate against anyone;
• use offensive, hateful or misleading callsigns, or impersonate other people or our staff;
• spam, scam, advertise, or share other people’s personal information; or
• use the services for anything illegal.

What happens if you break the rules

We may warn you, rename your callsign, remove you from matches, reset your statistics, or suspend or ban your profile, devices or connections, depending on how serious the problem is. For serious cases, such as cheating, threats or hate, we may act immediately and without warning.

If you think we got it wrong, email support@skyscrap.fun within 30 days and a person will review the decision.

Purchases and virtual items

Skyscrap sells nothing today. If we ever offer optional purchases, they will be cosmetic only and never affect how a match plays. Before anything goes on sale we’ll publish purchase terms covering prices, refunds and your consumer rights.

Virtual items and in-game currencies have no cash value and can’t be exchanged for money, except where the law requires otherwise. If you play inside a platform that has its own currency, that platform’s terms also apply to anything you spend there.

Other platforms

You may be able to play Skyscrap through other companies’ websites or apps. Their terms and privacy policies apply to their services as well as ours, and we’re not responsible for how they work.

Your content and feedback

You keep your rights in what you create, such as your callsign, reports, clips you send us or posts about the game. You give us a worldwide, royalty-free licence to use, display and store it as needed to run the services; for example, showing your callsign to other players.

If you send ideas or feedback, we may use them freely without paying you or crediting you. We appreciate it all the same.

Our intellectual property

The game, its code, art, characters, arenas, sound, music, the Skyscrap name and logo, and this website belong to us or our licensors and are protected by law. These terms don’t give you any rights in them beyond the licence above and our fan content policy.

Disclaimer

To the extent the law allows, the services are provided “as is” and “as available”, without warranties of any kind, including that they will be uninterrupted, error-free or suitable for a particular purpose. Nothing in these terms affects rights you have as a consumer that cannot be excluded by agreement.

Limits on liability

To the extent the law allows:

• we are not liable for indirect or consequential loss, or for loss of profits, data, profiles, statistics or progress; and
• our total liability to you for any claim about the services is limited to the greater of the amount you paid us in the 12 months before the claim and 50 US dollars (or the equivalent in your currency).

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit.

If your misuse causes claims

To the extent the law allows, if you break these terms or the law while using the services, for example by attacking our servers, and someone brings a claim against us because of it, you agree to cover our reasonable costs of dealing with that claim.

Ending this agreement

You can stop using the services at any time. To remove guest play data, clear the site data for Skyscrap in your browser; to delete an online profile, email privacy@skyscrap.fun.

We may suspend or end your access if you break these terms, or stop offering the services altogether, giving notice where we reasonably can. Sections that by their nature should continue, such as those on intellectual property, liability and disputes, continue after this agreement ends.

Changes to these terms

We may update these terms as Skyscrap changes, for example when online play launches. We’ll update the date at the top and, for significant changes, give notice on this site or in the game before they take effect. If you keep using the services after that, the new terms apply; if you don’t agree, please stop using them.

Governing law and disputes

Please talk to us first: email legal@skyscrap.fun and we’ll try to sort things out within 30 days.

These terms are governed by the laws of Kenya, and disputes go to the courts of Nairobi, Kenya. If you use the services as a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts.

General

• These terms, with the documents they refer to, are the whole agreement between us about the services.
• If a court finds part of these terms unenforceable, the rest still applies.
• If we don’t enforce a term straight away, we can still enforce it later.
• We may transfer this agreement to a company that takes over Skyscrap; your rights won’t be reduced as a result. You may not transfer it without our consent.
• These terms are written in English. If we translate them, the English version applies where they differ.
